General Business and Delivery Conditions

1. Preamble

The company Max Bauer Publishing, s.r.o. is the administrator of the internet shop www.evinka.com , specialized in selling the original porcelain dolls under the Evinka brand name (hereinafter "the Seller")

2. Order

The order submitted via the internet shop www.evinka.com is binding. By filling out, submitting and confirming the order form, the Buyer confirms he/she read these Business Conditions, and accepts them. At the same time he/she confirms, he/she has read and accepted the Claim Regulations, which are an integral part of these General Business and Delivery Conditions.

It is necessary to fill out all the information required by the registration form, and confirm that the Buyer agrees with the content of the order.

The delivery place is the address filled out by the Buyer in the registration form. The Buyer gains the ownership of the goods after paying the purchase price and accepting the goods. By filling out the registration form and submitting the binding order within the internet shop www.evinka.com, the Buyer agrees with and accepts the collection, gathering, and archiving of the personal data on the Buyer and his purchases.

3. Payment conditions, dispatch and delivery terms, transfer costs

The ordered goods are dispatched, at the latest, the fifth working day after the payment has been confirmed to the seller's account. If delivering abroad, the customer agrees with the fact, that with respect to the necessity of the custom clearance, the delivery term can be extended.

If the goods are not temporarily available in the storage, or other unexpected circumstances occur, the seller has the right to extend the dispatch term. In all these cases, the customer shall be immediately informed by e-mail, or on customer's expressed requirement, by phone.

The delivery terms adhere to the Czech Post conditions or to conditions of any dispatch service chosen by the customer while the order execution. The customer will be informed on the delivery date by e-mail as soon as possible after the order confirmation.

4. Claims

The contingent claims will be handled in conformity with the Claim Regulations of the internet shop www.evinka.com, and with the system of the law enforceable in the Czech Republic. The contingent trials abide the enforceable and legal regulations of the Czech Republic. The Claim Regulations are an integral part of these Business Conditions.

5. Final provisions

These Business Conditions listed on the website www.evinka.com are enforceable since April 1, 2006. By submitting the electronic order, the buyer accepts without any exceptions all provisions of the Business Conditions at the time of submitting the order, and the price of the ordered goods (including packaging and shipment) listed on the internet shop's website, unless agreed differently, and by confirming the order.

By submitting the order the Buyer pledges to pay for the goods at the agreed price, and to properly accept the goods. Further, the customer is consentient with the fact, that unless literally stated otherwise in these conditions, their mutual discretions and duties adhere to the Commercial Code of the Czech Republic.

6. Payment, shipping, packaging, shipment, insurance

Payment: money transfer to the account of the Seller. Following the order sent by the customer, an order confirmation e-mail will be sent along with an order number, which is, at the same time, the variable symbol serving for the payment identification. If delivering within the Czech Republic, the amount already includes the packaging and shipping fees, and the shipment insurance. If delivering abroad, the packaging and shipping fees, and shipment insurance is paid by the customer. If delivering using a dispatch service, the customer pays the difference between the shipping and the dispatch service price.

The goods are dispatched by return, after the payment verification, in the dispatch term listed in the Business Conditions.

7. Claim Regulations

The Buyer is obliged to check and control the goods delivered by the Seller without any undue delay. If any defects are found, the Buyer is obliged to inform the Seller by e-mail, or by phone, not later than 3 days after the acceptance of the goods.

If any claimable defect shall occur on the goods delivered by the internet shop, the Buyer can file a claim by e-mail, or in writing. The notice in writing shall be sent by the Buyer to the following address:

The Seller is obliged to inform the Buyer on the claim procedure within three working days of the receipt of such claim.

For the settlement of the claim, it is necessary to submit the payment receipt. Depending on the kind of defect, and based on the conditions settled is abided by the binding general legal regulations. The claim notice must contain: first name and surname, address, electronic address (e-mail), and a description of the defect (if possible, description of its occurrence).

The Seller does not accept the responsibility for damage caused by inappropriate use of the products, external events, or faulty manipulation. No warranty covers any damage of such origin.

In case the customer shall decide to exchange the goods, or to file a claim, the customer shall pay only the shipping of the goods before the claim is carried out. The shipping of the goods after the claim is carried out shall be paid by the internet shop www.evinka.com.
